Right now, Marion County is attempting to implement measures that destroy the 4th Amendment, with the full support of West Virginia U.S. Senators Shelley Moore Capito and Joe Manchin.

These measures, which include warrantless surveillance and the creation of a digital identity ecosystem, threaten the freedom of every West Virginian.

In response, Delegate S. Chris Anders has partnered with State Senator Christopher Rose to introduce legislation that restores and protects your 4th Amendment rights.

Key highlights of the bill:

1. No Surveillance Without a Warrant
Prohibits the use of real-time security monitoring technologies, including:

  • Multimodal vehicle recognition

  • Facial recognition

  • “Gun” recognition

  • Drones and license plate readers

Unless a warrant is issued based on probable cause for a specific person.

2. No Digital Identity Ecosystems
Bans the creation or implementation of digital identity systems in West Virginia.

3. Halt Existing Programs
Requires the immediate halt of any such surveillance or identity systems currently in use by state, county, municipal, or city entities.

4. Strict Penalties for Violations

  • Violators face felony charges, including a minimum of 1 year and 1 day imprisonment.

  • Civil penalties of $10,000 per occurrence will also apply.

5. Empowering Citizens
Gives citizens the right to seek damages in civil court if their 4th Amendment rights are violated.

West Virginia deserves better than this creeping surveillance state. Together, we can ensure that our state remains a place where freedom and privacy are respected.

The 4th Amendment protects your right to privacy. Programs using facial recognition, "gun" recognition, and other surveillance technologies without a warrant violate the Constitution and due process of law.

We, the undersigned, demand that our state elected officials pass the Fourth Amendment Restoration Act to:

  • Immediately stop unconstitutional surveillance programs like those in Marion County.

  • Restore the right to privacy for all West Virginians.

  • Ensure that no surveillance technology is used without a warrant issued based on probable cause.
